October 2, 2000

The Burlington City Council met in regular session at 7:00 p.m. with Mayor Scott, Council Members Edwards, Kellogg, Thomas and Wehrle present.

CONSENT AGENDA: To the Public:

All matters listed under Item I., Consent Agenda, having been discussed were considered to be routine by the City Council and were enacted by one motion. There was not separate discussion of these items. If discussion was desired, that item was removed from the Consent Agenda and was considered separately.

MOTION: To approve all listed under Item I., Consent Agenda.

DISCUSSION: Mayor Scott reviewed the items listed on the consent agenda to the viewing audience. Council Member Thomas announced those individuals appointed to various City commissions and boards. All present had opportunity to speak and nothing additional was filed in the office of the City Clerk.

ORDINANCE:

1. Motion for Preliminary Adoption of the Second Reading of An Ordinance Amending Section 10.52.020 One-Way Streets of Chapter 10.52 Controlled Access Facilities, One-Way and Stop Streets of the Burlington Municipal Code

DISCUSSION: The City Manager stated that the proposed Ordinance provides that Grube between Steuben Street and DeKalb Street be made a one-way street southbound and Court Street, eastbound from Fifth Street to Fourth Street be made a two-way street. He stated that both requests were by public input and/or petition. He stated that there were no changes from the first reading of the Ordinance. Those who spoke in favor of making Grube between Steuben Street and DeKalb Street into a one-way street were as follows: Alan Neff of 2307 Steuben Street; Bob Zurmuehlen of 2302 Steuben Street; and Joe Hassman of 2303 Steuben Street. Those who spoke were concerned that the street was too narrow and created safety problems. They urged Council to come out and take a look at their street. Those who spoke against making Grube between Steuben Street and DeKalb Street into a one-way street were as follows: Jeff Hammarstom of 2305 DeKalb Street and Radenna Heinz. Jeff Hammarstom stated his concern for safety in having to make an U-turn at the corner of DeKalb and Grube or having to back up onto DeKalb Street. He stated that his letter of September 11, 2000 explains his safety concerns. Radenna Heinz stated that part of the problem was children in the neighborhood playing in the street. She further stated that there was never a time that two cars could meet on Grube. She urged Council to leave Grube as a two-way street. Jerry Adams representing neighbors of the 400 block of Court Street urged Council to keep Court Street a two-way street. He stated that they have become accustomed to the one-way street and also stated a two-way street would make the traffic flow tighter. Mayor Scott and Council Member Wehrle stated that they have heard from a lot of citizens that feel Court Street (a 31-foot street) should be a two-way street. Charlie Eads of 2012 South 4th Street also felt that Court Street should be a two-way street since the hospital has moved out of downtown Burlington. Mayor Scott stated that the Grube Street was a "neighborhood situation." He suggested that the property owners in the neighborhood (Grube/DeKalb/Stueben) bring the City a petition with 75% (super majority) of the property owners in favor of making Grube Street a one-way street. After considerable discussion by Council, Council Member Edward made a motion to amend the proposed Ordinance by deleting Grube Street, southbound from Steuben Street to DeKalb Street as a one-way street. Council Member Thomas seconded the motion. After roll call vote the motion to amend was unanimously approved. The motion for preliminary adoption of the second reading of the proposed Ordinance, as amended by Council, was approved with Mayor Scott and Council Members Edwards, Kellogg and Wehrle voting in favor of the Ordinance as amended. Council Member Thomas voted against the Ordinance as amended. All present had opportunity to speak and nothing additional was filed in the office of the City Clerk.

2. Motion to Amend Proposed Ordinance Amending Section 10.52.020 One-Way Streets of Chapter 10.52 Controlled Access Facilities, One-Way and Stop Streets of the Burlington Municipal Code by Deleting the Following One-Way Street: Grube Street, Southbound from Steuben Street to DeKalb Street

DISCUSSION: None.

(VOTE: 5 - "AYES") CARRIED

RESOLUTIONS:

1. Resolution Approving the Preliminary Plat of Golfer's Grove Subdivision

DISCUSSION: The City Planner stated that Golfer's Grove Subdivision was located southeast of the intersection of Highway 61 and Memorial Park Road in Des Moines County. He stated that the petitioner, Jeff Jennison, plans to subdivide the existing property into three lots for residential development and one outlot for transfer to an adjacent property owner. He stated that the City Planning Commission voted to accept the preliminary plat subject to the plat meeting the requirements set forth in the Des Moines County Subdivision Ordinance. All present had opportunity to speak and nothing additional was filed in the office of the City Clerk.

2. Resolution Approving the Final Plat of Golfer's Grove Subdivision

DISCUSSION: None.

VOTE: 5 - "AYES") ADOPTED

3. Resolution Approving Preliminary Plat Flint Ridge Business Park Subdivision

DISCUSSION: The City Planner stated that Flint Ridge Park Subdivision was located west of West Burlington Avenue and north of the intersection of Division Street and West Burlington Avenue. He stated that BADCO plans to subdivide the existing lot four of Flint Ridge Business Park Subdivision into eight lots for industrial development. He stated that one lot would transfer to an adjacent property owner and one lot would be dedicated as public right-of-way. He stated that staff would suggest the following requirements: along the north side of the subdivision utility easements would be located along the northern edge of the subdivision; the right-of-way should be preliminary platted to the south edge of lot four to create a future internal drive to the south across lot five that would ultimately exit onto Division Street, therefore, if lot five to the south is ever divided, as lot four is being divided, there would not be an additional cul-de-sac created nor would it be acceptable to the City. All present had opportunity to speak and nothing additional was filed in the office of the City Clerk.
