BURLINGTON, IOWA, CITY COUNCIL
Special Meeting No. 18
March 31, 1999
The Burlington City Council met in Special/Executive Session at 5:00 p.m. with Mayor Scott,
Council Members Edwards, Henry, Thomas, and Wright present
SPECIAL MEETING NOTICE ACKNOWLEDGED
MOTION: To go into Executive Session for the purpose of: To discuss the strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation per State Code, Chapter 21.5.1.(c).
(VOTE: 5 - "AYES") CARRIED
MOTION: That the Executive Session be adjourned, and Council go back into Special Meeting.
(VOTE: 3 - "AYES" THOMAS, EDWARDS, HENRY
2 - "NAYS" SCOTT, WRIGHT) CARRIED
DISCUSSION: Council Member Henry stated that the Council should direct the Mayor or Manager to discuss with the Department of Education the questions of whether AEA has received approval to purchase property, bring up the 1994 Attorney General's opinion, and state that they are not in compliance with State Code. Council Member Thomas agreed with Council Member Henry. Mayor Scott agreed that there was a need to check with the Department of Education as the City needed to preserve the City's tax base and adaptive reuse of buildings in the community. Council Member Henry made a motion to direct legal counsel to quickly raise the question to the Department of Education. Council Member Thomas seconded the motion. After roll call vote the motion was unanimously approved. Council Member Wright stated that he would like to develop a strategy now. Council Member Henry stated that if the purchase was not done correctly, the City should object to it. All present had opportunity to speak and nothing additional was filed in the office of the City Clerk.
(VOTE: 5 - "AYES") CARRIED
MOTION: To direct legal counsel to quickly raise the question to the Department of Education.
(VOTE: 5 - "AYES") CARRIED
