OF THE BURLINGTON, IOWA CITY COUNCIL

Meeting No. 35

June 7, 1999

The Burlington City Council met in regular session at 7:00 p.m. with Mayor Scott, Council Members Edwards, Henry, Thomas and Wright, present. Council Member Thomas introduced Miss VanHagen's North Hill School 5th Grade Extended Learning Program students. The students led the Council in the Pledge of Allegiance. All present had opportunity to speak and nothing additional was filed in the office of the City Clerk.

CONSENT AGENDA: To the Public:

All matters listed under Item I., Consent Agenda, having been discussed were considered to be routine by the City Council and were enacted by one motion. There was not separate discussion of these items. If discussion was desired, that item was removed from the Consent Agenda and was considered separately.

MOTION: To approve all listed under Item I., Consent Agenda.

DISCUSSION: Mayor Scott reviewed those items listed on the consent agenda. Council Member Henry announced those individuals appointed to various City commissions and boards. All present had opportunity to speak and nothing additional was filed in the office of the City Clerk.

HEARINGS:

1. Statement: Consideration of An Ordinance Amending the Municipal Zoning Ordinance, Title 17, of the City Code of Burlington, Iowa, by Amending Section 17.66.080 District Signage Regulations of Chapter 17.66 Signs

COMMENTS: The Chief Code Inspector reviewed with Council and the viewing audience the proposed Ordinance Amending Section 17.66.080 District Signage Regulations of Chapter 17.66 Signs. He stated that the proposed Ordinance eliminates the distance separation requirement for freestanding signs. All present had opportunity to speak and nothing additional was filed in the office of the City Clerk.

Motion to Close CARRIED

Motion for preliminary adoption of the first reading of An Ordinance Amending the Municipal Zoning Ordinance, Title 17, of the City Code of Burlington, Iowa, by Amending Section 17.66.080 District Signage Regulations of Chapter 17.66 Signs

DISCUSSION: None.

(VOTE: 5 - "AYES") CARRIED

2. Statement: Consideration An Ordinance Amending the Land Use Map and the Municipal Zoning Map and Title 17, Zoning Ordinance, of the City Code of the City of Burlington, Iowa, by Rezoning the Diewold Plaza Subdivision from "R-1A" One-Family Residential District and "R-1B" One-Family Residential District to the Diewold Plaza P.U.D. (Planned Unit Development)

COMMENTS: The City Planner reviewed with Council and the viewing audience the proposed Ordinance Rezoning the Diewold Plaza Subdivision from "R-1A" One-Family Residential district and "R-1B" One-Family Residential District to the Diewold Plaza Planned Unit Development. He further reviewed the following changes that the Plan Commission had made to the proposed Ordinance: conditions; land use design criteria; signage requirements; fifty foot buffer park; buffering; and pedestrian sidewalks. Dennis Grizzle of 2924 Dill stated that he was happy to see the changes made to the Ordinance that the Plan Commission had recommended. He stated that he would also like to see the following changes: better definition of storm water runoff; berming; and buffering behind buildings where outside storage is located at a home improvement retail establishment. Council Member Henry stated his concerns regarding: 50 ft. buffer be maintained on outlot B; street access to West Avenue; and storm water management. The City Planner stated that when a developer develops the outlots the Council would need to amend the P.U.D. Ordinance. The City Manager stated that same barriers would be provided in the amended Ordinance as the lots are developed. All present had opportunity to speak and nothing additional was filed in the office of the City Clerk.

DISCUSSION: Mayor Scott and Council Member Henry stated that they were glad to see the proposed rezoning of approximately 11 acres from Residential to Planned Unit Development. All present had opportunity to speak and nothing additional was filed in the office of the City Clerk.

(VOTE: 5 - "AYES") CARRIED

RESOLUTION:

1. Resolution Approving Final Plat for the Third Addition to Oak Hills Subdivision

DISCUSSION: The City Planner reviewed with Council and the viewing audience the proposed final plat for the Third Addition to Oak Hills Subdivision. He stated that the subdivision is located in Des Moines County but was within the City's two-mile jurisdiction review. He stated that the conditions to the final plat were as follows: all County Subdivision regulations are enforced; and annexation of this subdivision into the City of Burlington will require the property owners to bring an existing infrastructure associated with this subdivision into conformance with City standards. He stated that the final plat of the Fourth Addition to Oak Hills Subdivision will be coming to the Council at a later date. All present had opportunity to speak and nothing additional was filed in the office of the City Clerk.

(VOTE: 5 - "AYES") ADOPTED

COMMENTS FROM AUDIENCE: Victor Clegg of 512 South 6th Street requested that Council place a sign on the street near Kersh Park that children are playing. He stated that the cars traveling up the hill are driving very fast and they need to be slowed down. Terry Young of 510 South 6th Street agreed with Victor Clegg that a sign would be nice. He further suggested speed bumps be placed on the top and the bottom of the hill with parking allowed only on one side of the street during the winter months. He further stated that the alley behind Union Baptist Church located in the 200 block of South Central needed some attention. All present had opportunity to speak and nothing additional was filed in the office of the City Clerk.
