THE BURLINGTON, IOWA, CITY COUNCIL

Special Meeting No. 8

June 29, 1998

The Burlington City Council met in special session at 4:30 p.m. with Mayor Scott, Council Members Edwards, Henry, Thomas, and Wright present.

SPECIAL MEETING NOTICE ACKNOWLEDGED

RESOLUTIONS:

1. Resolution Awarding Contract for the 1998 Riverfront Improvements, Phase III

DISCUSSION: The Public Works Director briefly reviewed the plans for the 1998 Riverfront Improvements, Phase III and recommended that the contract be awarded to First Commercial Construction Corporation for a total amount of $1,679,150.00. The City Manager stated that the total project, including design costs, will cost roughly 1.86 million dollars. The City has 1.95 million dollars in hotel/motel tax, gambling tax from the City and Burlington Area Development Corporation, and Catfish Bend Riverboat Casinos lease payments to pay for the project. Dave Hanrahan, 1709 Oak Street, stated that his experience has been that fountains are nothing but problems. Mayor Scott stated that any left over monies could possibly be used for boat docks near the north boat ramp, a fish cleaning station, or public restrooms, etc. All present had opportunity to speak and nothing additional was filed in the office of the City Clerk.

(VOTE: 5 - "AYES") ADOPTED

MOTION: To go into Executive Session for the purpose of: To discuss the strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation per State Code, Chapter 21.5.1 (c).

(VOTE: 5 - "AYES") CARRIED

MOTION: That the Executive Session be adjourned, and the Council go back into Special Meeting

DISCUSSION: None.

(VOTE: 5 - "AYES") CARRIED
