Special Meeting No. 31

May 12, 1997

The Burlington City Council met in Special/Executive Session at 4:15 p.m. with Mayor Sandell, Council Members Heland, Henry, Scott and Thomas, present.

SPECIAL MEETING NOTICE ACKNOWLEDGED

MOTION: To go into Executive Session for the purpose of: To discuss the strategy with counsel in matters that are presently in litigation or where litigation is imminent where its disclosure would be likely to prejudice or disadvantage the position of the governmental body in that litigation per State Code, Chapter 21.5.1.(c).

(VOTE: 5- "AYES") CARRIED

MOTION: That the Executive Session be adjourned, and Council go back into Special Meeting.

DISCUSSION: Mayor Sandell stated that the City has reached a settlement in the Winegard lawsuit. He stated action regarding the lawsuit would be on the May 19, 1997 Agenda. All present had opportunity to speak and nothing additional was filed in the office of the City Clerk.

(VOTE: 5- "AYES") CARRIED
