BURLINGTON, IOWA, CITY COUNCIL
Special Meeting No. 41
October 27, 1997
The Burlington City Council met in Special/Executive Session at 6:00 p.m. with Mayor Sandell,
Council Members Heland, Henry, Scott and Thomas, present.
SPECIAL MEETING NOTICE ACKNOWLEDGED
RESOLUTION:
1. Resolution Approving Lease with Catfish Bend Casinos LC
DISCUSSION: Mayor Sandell stated that the City Council had already held a hearing on the lease with Catfish Bend Casinos LC. He stated that the action before the Council was approving the lease. Dan Kiehl, General Manager for Catfish Bend Casinos, thanked the Council for having a special meeting to approve the lease. He asked that Council look favorably upon the lease. Linda Long of 2202 Racine stated her concern for the proposed directional sign for Catfish Bend Casino. She stated that the boat was large enough for people to see and find. The Interim City Manager stated that in conversation with Dan Kiehl, Catfish Bend was agreeable that the sign may also be a community event type sign for Burlington. Mayor Sandell stated that the City's original plan was to add a marquee at Memorial Auditorium. He stated that the marquee may not be needed if the sign for Catfish Bend becomes a community event type sign. Linda Long stated that she would like to know in advance of the boat docking in Burlington how long it plans to stay so that area residents could plan spring events. Dan Kiehl stated that he should know whether they would be staying longer due to a marketing event, but would not as far as environmental concerns. Dave Walker, Chairperson of BADCO thanked the Council for working together with Catfish Bend Casino on the lease. He stated that there would be a number of improvements that will be made on the riverfront due to the partnership with Catfish Bend Casino, the City and BADCO. Council Member Henry stated that the lease provides that the lessee may install at its expense ramps and/or canopies between the Port of Burlington Building and the lessee's riverboat facility for use by its patrons and employees, provided that such amenities are removed by lessee each year when the lessee's riverboat is not docked in Burlington. He stated that he would like to see an amendment at sometime that the canopies would stay during the summer months when Catfish Bend Casinos is not docked in Burlington. Dan Kiehl stated that he would have design approval of the canopy approved by the City and was willing to work with the City in regard to the issue. Mayor Sandell stated that he could think of possibly three user groups that may not be happy with canopies staying during the summer months. Council Member Scott questioned if there would be a need to removed the existing displays at the Port of Burlington Building. Dan Kiehl stated that the existing displays at the Port of Burlington Building would not need to be removed. Council Member Henry made a motion to amend the last sentence in Section 13 Part-time Operation of the lease between Catfish Bend Casinos LC and the City of Burlington to read as follows: Lessor and Lessee shall mutually agree in advance to any adjustment of the dates to accommodate external environmental and or marketing conditions. Council Member Scott seconded the motion. After roll call vote by the City Clerk the amendment was approved unanimously. All present had opportunity to speak and nothing additional was filed in the office of the City Clerk.
(VOTE: 5-"AYES") ADOPTED
2. Motion to Amend the last sentence in Section 13 Part-time Operation of the lease
between Catfish Bend Casinos LC and the City of Burlington to read as follows: Lessor
and Lessee shall mutually agree in advance to any adjustment of the dates to
accommodate external environmental and or marketing conditions
DISCUSSION: None.
(VOTE: 5 - "AYES") CARRIED
