TREE SERVICE BUSINESS

128.01    DEFINITION. Unless the context otherwise requires, “tree service business,” as used in this chapter, includes every person engaged in the business of trimming trees, cutting trees, topping trees, treating trees, removing stumps or in any manner cutting, severing or removing any portion of all of a tree for compensation within the City.

128.02    LICENSE REQUIRED. It is unlawful for any person to engage in a tree service business without obtaining an annual license from the City.

  1. Application. Application for a license shall be made in writing to the Clerk on forms furnished by the Clerk. The application shall include:

  1. Applicant’s full name, phone number, fax number and name of business and business address.

  2. The specific nature and type of business proposed to be carried on within the City, list of equipment, copies of ownership of vehicles and equipment (proof of insurance certificate or vehicle title or declaration page of insurance listing vehicle and ownership); copies of lease agreements if leasing vehicles; copy of Iowa sales tax permit.

  3. A statement of the training, experience or other qualifications pertaining to the type of work to be done within the City.

  4. Names of all employees of the business.

  5. Such other information as may be required by the Clerk.

  1. Insurance Required. Each applicant shall also have filed a certificate of insurance indicating that the applicant is carrying public liability insurance in effect for the duration of the license covering the applicant and employees for the following amounts:

Bodily Injury: - $100,000 per person

- $300,000 per occurrence

Property Damage: - $50,000

  1. License Fee. The annual fee and renewal fee for a tree service business shall be established by resolution of the Council. The fee is payable in advance and is nonrefundable.

  2. License Issued. Upon completion of the application, filing of insurance certificate and payment of the required fee, the Clerk shall issue a license, specifically naming each employee of the applicant. The license thus issued shall not be transferable, and each license shall be carried to each job site as proof of licensing. All licenses shall expire on December 31 of each year.

  3. License Renewal. A license may be renewed in the same manner as the original issuance.

128.03    VEHICLE IDENTIFICATION. Each vehicle used by the tree service business shall have the name of the business in clearly legible letters on each side of the vehicle.

128.04    NOTICE OF INELIGIBILITY. If the applicant does not furnish evidence to the Clerk that said applicant has complied with all of the provisions of this chapter and is a proper and qualified person to engage in the tree service business, then the Clerk shall advise such person in writing that he or she is ineligible to operate a tree service business in the City.

128.05    PROTECTION OF UTILITY FACILITIES. Every licensee, before commencing work on any tree or any stump, shall determine the whereabouts of utility facilities in the area and shall be responsible for contacting the utility company or companies to arrange for the protection of such facilities. This section applies to both overhead facilities and underground facilities.

128.06    WORK AREA TO BE CLEANED. It is the obligation of every licensee to clean up the area where said licensee is working or has completed work and to remove all branches, twigs and chips in addition to larger portions of trees, and to haul such debris to the proper disposal site or to otherwise dispose of such debris in such manner that it will not remain on City streets and so that it will not flow into City sewers, or have to be hauled by the City.

128.07    NOTIFICATION OF FIRE AND POLICE DEPARTMENTS. Every licensee under this chapter shall notify the Fire and Police Departments of the City of all proposed work to be done on City property and shall list with the Street Department the exact address where such work is to be done and the nature of the work.

128.08    SAFETY PRECAUTIONS. Each licensee, in order to insure safe operations to the operator and the general public, shall equip all power machinery used in connection with the tree service business with all reasonable safety precautions.

128.09    PENALTY. Any person violating any of the provisions of this chapter shall, upon conviction, be subject to the penalties set forth in Section 1.14 of this Code of Ordinances.
