CHAPTER 32

CABLE TELEVISION COMMISSION

32.01    CREATION; COMPOSITION. There is established a Cable Television Commission consisting of five (5) members, all appointed by the Mayor with approval of the Council. All members shall be residents of the City and shall be appoint for staggered two-year terms.

32.02    VACANCIES. Any member who misses three (3) meetings consecutively without a valid reason shall be considered to have vacated the position. A vacancy shall be filled only for the balance of the term, except at the end of a full term, at which time appointments shall be for a two-year term.

32.03    OFFICERS. The Commission shall annually elect a Chairperson, Vice Chairperson and Secretary. A member shall not serve two full consecutive terms in a single office.

32.04    COMPENSATION. The members of the Cable Television Commission serve without compensation, except for pre-approved expenses while acting in an official capacity as a Commission member.

32.05    MEETINGS. The Cable Television Commission shall meet at least once every three (3) months on a regular basis or at the call of the Chairperson or on the request of at least three members. The place of the meeting and the subjects to be discussed shall be listed on the previously posted agenda and the Secretary of the Commission shall promptly file a report of its minutes with the Council after each meeting.

32.06    POWERS AND DUTIES. The Cable Television Commission has the following powers and duties:

  1. To receive and investigate complaints lodged against the franchisee and make recommendations to the City Attorney prior to the final Council action;

  2. To receive and investigate all franchisee requests to adjust basic tier rates according to regulations set out in Chapter 113 of this Code of Ordinances and make recommendations to the City Attorney for compliance review with the Cable Act before final action by the Council.
